The purpose of this Privacy Statement is to provide you, in a clear and transparent manner, information concerning the processing of your personal data (hereinafter "personal data") by SPRL A&G FUNERAL GROUP (CBE 0457.948.678) and all related companies within the group of which SPRL A&G FUNERAL GROUP is a part, whose registered office is at Avenue Oscar Van Goidtsnoven 6, 1180 BRUXELLES, Belgium (hereinafter "we").

1- What type of personal data do we process about you?

The personal data we process are as follows:

  • Identification data (e. g. surname and first name, date of birth, address, nationality, national register number, images) ;
  • Contact data (e.g. telephone number, address and e-mail address) ;
  • Economic and financial data (e.g. account number) ;

In addition, in the context of the fulfilment of the contract which binds us, we may process certain data which may give information about your health, sexual orientation, religious or philosophical convictions, depending on what you would like to make known to third parties (in particular when establishing death announcements, obituaries, etc.).

With the exception of the latter data, we do not process - except at your express request - any sensitive personal data that reveal your racial or ethnic origin, trade union membership, as well as genetic data or biometric data for the purpose of uniquely identifying a natural person.



2- For what purpose and on what basis do we process your personal data?

We process your data according to the following principles :

  • You have consented to the processing of your personal data for one or more specific purposes ;
  • The processing of your personal data is necessary for the conclusion and performance of a contract to which you are a party (as a customer) ;
  • The processing of your personal data is necessary for us to comply with our legal obligations (accounting, invoicing, etc.) ;
  • The processing of your data serves our legitimate interests (litigation management, improvement of our services, etc.) ;

We process your data for the following purposes :

  • Your registration as a client, in order to manage your file;
  • The management of your file from start to finish;
  • The preparation and provision of funeral services of all types, according to your wishes;
  • Commercial development.



3- With whom do we share your personal data?

We transmit some of your data in order to accomplish the above-mentioned purposes to :

  • Different funerals services providers corresponding to your requests;
  • IT/web service providers in the preparation and testing of customer and file management software;
  • Regulated professions such as lawyers, bailiffs, accountants, in the case of the management of our accounting or a possible dispute.

We have communicated to all our subcontractors the obligations that bind them to us in terms of protecting your personal data. Under no circumstances may subcontractors process the data we transmit to them for purposes other than those we have identified and which are included in this declaration.

Except in the case of repatriation from abroad, we do not transfer your personal data to third countries in the European Economic Area.



4- How long do you keep your personal data?

Your personal data are only kept for the time necessary for our processing purposes.

This period is 10 years from the end of our contractual relationship.

Data not necessary for the implementation of our or your contractual liability is not stored. Beyond the above-mentioned period, your data are archived, in particular for the purpose of possible historical and genealogical research.



5- What are your rights and how can you enforce them?

The rights you have in the context of the protection of your personal data are as follows :

  • Right to erase: you have the right to request the erasure of your personal data ;
  • Right to limit processing: you have the right to request that the processing of your personal data be limited ;
  • Right of opposition: you have the right to object to the processing of your personal data ;
  • Right to withdraw your consent: you have the right to withdraw your consent to the processing of your personal data ;
  • Right to the portability of your data; you have the right to request, where technically possible, that your personal data be returned to you or transferred to a third party.
